Terms of Use for Employers

1. Introduction

Welcome to kiwicareer.com (the “Service”), operated by Kiwi Placements And Services FZ-LLC (the “Company”), registered under license at VUPR0435, Compass Building – Al Hulaila, Al Hulaila Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates.

These Terms and Conditions of Use (the “Terms”) govern your use of this Service as an employer or recruiter, including services and content provided by the Company, its affiliates, and third parties. By accessing or using the Service, you (“Employer”) agree to be bound by these Terms and the applicable laws and regulations of the United Arab Emirates (“UAE”).

The Company reserves the right to amend these Terms at any time without prior notice. Your continued use of the Service constitutes acceptance of such amendments.

 

2. Acceptable Use of the Service

The Service is designed to facilitate lawful connections between job seekers and employers:

  • Employers/Recruiters: May use the Service strictly for internal business purposes related to posting genuine job vacancies, sourcing candidates, and managing recruitment.
  • Prohibited Use: Any misuse of the Service, including the posting of misleading, fraudulent, or unlawful content, is strictly prohibited under UAE law, including but not limited to Federal Decree-Law No. 33 of 2021 (UAE Labour Law).

Employers are solely responsible for ensuring that all job postings and hiring activities comply with UAE labour, immigration, and anti-discrimination laws.

3. Payment Terms & Use of Payment Gateway

  • Payments made through the Service are processed securely via a third-party payment gateway.
  • The Company does not store any payment card details. All transactions comply with PCI DSS standardsand UAE Central Bank regulations.
  • By making payments through the gateway, you agree to the gateway’s terms and conditions.
  • Refunds: Fees paid for services are non-refundable, except where required by UAE consumer protection laws or at the sole discretion of the Company.
  • Any disputes related to payments must be raised in writing within 7 working daysof the transaction.

4. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which outlines how your business and personal data is collected, processed, and stored in compliance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL).

5. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, software, and trademarks, is protected under UAE copyright and trademark laws. Unauthorized use, copying, or distribution of any part of the Service is prohibited.

6. Disclaimer of Warranties

The Service is provided on an “as is” basis. The Company makes no warranties, whether express or implied, regarding the accuracy, reliability, or uninterrupted availability of the Service.

The Company is not a recruitment agency and does not guarantee:

  • That job postings will lead to successful employment.
  • That candidates will meet an employer’s qualifications or requirements.

7. Limitation of Liability

To the fullest extent permitted under UAE law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

  • Use or inability to use the Service.
  • Unauthorized access to or alteration of posted data.

8. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers, and employees against any claims, damages, liabilities, or expenses arising from your use of the Service, your job postings, or your breach of these Terms.

9. Rules for Posting, Conduct & Security

Employers agree to comply with the Company’s rules, including but not limited to:

  • Posting only genuine and lawful job vacancies.
  • Ensuring job postings comply with UAE labour and immigration laws.
  • Not posting defamatory, obscene, offensive, discriminatory, or illegal content.
  • Not engaging in unauthorized advertising, spamming, or fraudulent recruitment.
  • Not attempting to breach security, access unauthorized accounts, or disrupt the Service.

Violations may result in suspension or termination of access and may be reported to relevant UAE regulatory and law enforcement authorities.

10. Links to Third-Party Sites

The Service may contain links to third-party websites or social media platforms. The Company is not responsible for the content, accuracy, or reliability of such external sites. Accessing these sites is at your own risk.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws of the Ras Al Khaimah Free Zone.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE.

12. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Service.
